該訴訟稱，Tether 使用該公司的財產(chǎn)（比特幣）作為抵押品來償還攝氏度的未償貸款，違反了與攝氏度的代幣協(xié)議。攝氏聲稱這發(fā)生在其於 2022 年 7 月 13 日申請破產(chǎn)之前的 90 天內(nèi)。

代幣協(xié)議

起訴書稱，Celsius 和 Tether 於 2020 年 2 月簽署了代幣協(xié)議，允許加密貨幣貸方以 Ether、Tether Gold 或比特幣作為抵押品，從該公司借用 USDT。

雙方於 2022 年 1 月修訂了協(xié)議，並引入了一項要求，要求 Tether 在公司抵押品低於指定閾值時向攝氏度發(fā)送抵押品需求通知。協(xié)議提供了Celsius十個小時來滿足抵押需求。

Celsius 表示，根據(jù)修訂後的代幣協(xié)議，它從 Tether 借入了 512,330,000 USDT，並提供了 16,505.17 BTC 作為抵押品以確保貸款。

As Bitcoin’s price began to fall in April 22, Tether initiated several demands under the amended token agreement to improve its security on the antecedent debt owed to it by Celsius, the filing states. The crypto lender responded by depositing 16,737.27 Bitcoin as additional collateral, which it alleges was not held in segregated wallets or accounts.

While Celsius later borrowed more USDT from Tether and posted respective collaterals in Bitcoin, things went south on June 12, 2022, when Tether issued new demands for additional collateral.

Celsius Seeks $2B Clawback

Celsius claims that Tether sent the first demand late at night (Eastern time) on June 12, which was fulfilled by a transfer of 3,041.73 Bitcoin to the stablecoin issuer the following day. Several hours later, Tether reportedly made a second collateral demand to Celsius and “demanded immediate payment.”

This was contrary to the token agreement the two companies had signed.

Tether allegedly applied the entirety of Celsius’s collateral, 39,542.42 Bitcoin, at a dollar value of $816,822,948.

The contested Bitcoin is worth over $2 billion at current market prices.
